By downloading, accessing, or using JournDaily, you agree to these terms. They cover your rights, our responsibilities, and how the service works.

1. Acceptance of terms

By accessing or using the JournDaily applications or this website (“the App”, “JournDaily”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the App.

These Terms apply to all users, including those who access JournDaily through the web, the Apple App Store, or Google Play. By creating an account, you confirm you are at least 13 years old and have the legal capacity to enter into this agreement.

JournDaily is operated from the United Kingdom. Under UK GDPR and the ICO’s Age Appropriate Design Code, the minimum age for this service is 13. If you are located in an EU member state that sets a higher age of digital consent (up to 16), you must obtain verifiable parental or guardian consent before using the App. We do not knowingly allow users under 13 to create accounts; if we discover that a user is under 13 we will delete their account and associated data.

2. About JournDaily

JournDaily is a cloud-connected private-first journal for travel and everyday life, developed and operated by ALIV CODE Ltd (“we”, “us”, “our”). Features include a day diary, trips and chapters, photos and short video, places, following other people, Shared Chapters, and messages.

An account is required. Your data is stored on our servers as described in our Privacy Policy.

3. Account registration

To use JournDaily you must register with a valid email address (or Sign in with Apple where offered), a username, and a password. You are responsible for:

  • Providing accurate and current registration information
  • Keeping your password confidential
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised use at [email protected]

You may not create accounts on behalf of others without authority, use another person’s account, or register multiple accounts to circumvent restrictions.

4. Licence to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use JournDaily on devices you own or control, solely for your personal, non-commercial use.

You may not:

  • Copy, modify, or distribute the App or any part of it except as allowed by law
  • Reverse-engineer, decompile, or attempt to extract the source code except where that restriction is prohibited
  • Use the App to build a competing product or service
  • Sublicense or sell access to the App
  • Remove or alter proprietary notices or branding

5. Acceptable use

You agree not to use JournDaily to:

  • Violate any applicable law or regulation
  • Harass, threaten, or harm other users
  • Share content that is illegal, abusive, or infringes third-party rights
  • Attempt to gain unauthorised access to our systems or another user’s account or private journal
  • Transmit malware, spam, or disruptive code
  • Scrape, crawl, or systematically access the App or its data by automated means
  • Interfere with or disrupt the integrity or performance of the App

We may suspend or terminate accounts that violate these rules. Where required by applicable law, we will provide reasonable notice before permanent termination.

6. Your content

You retain ownership of the journal entries, photos, videos, captions, messages, and other material you create in the App (“Your Content”).

You grant us a limited licence to store, process, transmit, and display Your Content solely to operate JournDaily for you and for the people you have allowed to see it.

You represent that you have the rights needed to post Your Content, including photos of people who appear in them where consent is required, and that Your Content does not infringe anyone else’s rights.

7. Privacy of the journal and sharing

New journal entries are private. Sharing is a separate action. When you create a Shared Chapter, enable an unlisted link, add someone to a group trip, or otherwise grant access, you are responsible for choosing that audience. Unlisted links can be forwarded by anyone who has them. Rotate or disable a link if you need to cut off new visitors.

Group-trip members can read entries on that trip. Do not put people on a trip if you do not want them to see those pages.

We do not proactively read your private journal. We may access or disclose data when required by law, to investigate a report of abuse, or to protect the service and other users.

8. Social features, messages, and reports

Your username, display name, and avatar may be visible to people who search for you or view a profile or share you have allowed. You are responsible for what you send in messages and what you include in Shared Chapters.

If you encounter content or behaviour that violates these Terms, report it in the App or write to [email protected]. Reports are reviewed. We do not tell the other person who reported them. We may remove content or suspend accounts.

9. Intellectual property

All rights, title, and interest in JournDaily — including the app, website, design, code, branding, and associated intellectual property — belong to ALIV CODE Ltd. Nothing in these Terms transfers ownership to you.

You retain ownership of Your Content as described above.

10. Privacy and data protection

Your use of JournDaily is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you acknowledge the data practices described in that policy.

JournDaily processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Where we serve users in the European Economic Area, we also comply with the EU GDPR to the extent applicable.

11. Subscriptions and pricing

JournDaily is currently available without charge. If we introduce paid features, subscriptions, or in-app purchases, the following will apply:

  • Pricing will be disclosed before any purchase
  • App Store purchases are billed by Apple; Play Store purchases are billed by Google
  • Subscriptions renew according to the store’s rules unless you turn auto-renewal off in time
  • You manage or cancel store subscriptions in your Apple ID or Google account settings
  • Refunds for store purchases are handled by Apple or Google; we cannot process those refunds directly
  • We will give reasonable advance notice of pricing changes

12. Availability and changes

We aim to keep JournDaily available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the App at any time. We may also update features or these Terms.

We will make reasonable efforts to notify you of material changes (for example, in the app). Continued use after a change constitutes acceptance of the revised Terms. Where the app requires a new acceptance, you must accept before continuing.

13. Force majeure

We shall not be liable for failure or delay in performing our obligations where that failure or delay results from a cause beyond our reasonable control, including acts of God, fire, flood, earthquake, pandemic, governmental action, war or civil unrest, failure of third-party infrastructure or internet services, power failure, or failure of our hosting providers. Our obligations are suspended for the duration of such an event.

14. Disclaimer of warranties

JournDaily is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, secure, or free of harmful components.

Use of the App is at your own risk. JournDaily is a journal, not a backup service with a guaranteed restore. Keep your own copies of irreplaceable photos if you need them.

15. Limitation of liability

To the maximum extent permitted by applicable law, ALIV CODE Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use JournDaily, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount you paid (if any) for the App in the twelve months prior to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law. Your statutory rights as a consumer are unaffected.

16. Termination

You may stop using JournDaily and delete your account at any time from the App. Account deletion removes your data from our servers, subject to the retention exceptions in the Privacy Policy.

We may suspend or terminate your access if you breach these Terms, including violation of acceptable use, abusive behaviour, fraud, or unlawful conduct. We may also suspend accounts pending investigation.

17. Dispute resolution

If you have a complaint, contact [email protected] first. We will endeavour to respond within 14 days.

If we cannot resolve the complaint, you may be entitled to refer it to an Alternative Dispute Resolution scheme. Details of available ADR schemes can be found via the UK government’s dispute resolution service finder. Nothing in this clause limits your statutory rights as a consumer.

18. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without affecting mandatory consumer protections that apply where you live.

19. Accessibility

We aim to make JournDaily usable for as many people as we can, including following relevant parts of WCAG 2.1 for this website. If you hit a barrier, write to [email protected].

20. Apple App Store

If you download JournDaily from Apple, these Terms are between you and ALIV CODE Ltd only, not Apple Inc. Apple has no obligation to provide maintenance or support. To the extent permitted by law, Apple has no warranty obligation with respect to JournDaily. Apple is not responsible for addressing claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

21. Google Play

If you download JournDaily from Google Play, these Terms are between you and ALIV CODE Ltd. Google is not a party to these Terms and has no obligation to provide support for the App, except as Google’s own terms may separately require of Google.

22. Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated in the app. Your continued use of JournDaily after changes are posted constitutes acceptance of the revised Terms.
